This policy applies exclusively to B2B (Business to Business) sales between Cellcom Srl and companies, professionals and resellers.
⚠️ The right of withdrawal does NOT apply to B2B transactions, as established by the Italian Civil Code and current commercial regulations.
Exclusion of the Right of Withdrawal for B2B
Pursuant to Italian law, purchases between companies and professionals do NOT fall within the protection provided for private consumers (Legislative Decree 206/2005 – Consumer Code).
✅ In B2B sales, the right of withdrawal within 14 days is not provided for, unless otherwise contractually agreed between the parties.
✅ Once the order has been confirmed and paid for, it is not possible to cancel it or return the goods, except for confirmed defects or non-conformities.
📌 Exceptions: Any requests for returns for commercial reasons may be evaluated at the discretion of Cellcom Srl, but only with prior written agreement.
Legal Guarantee for B2B
For B2B sales, the warranty is regulated by the Italian Civil Code (Art. 1490 et seq.) and the following conditions apply:
- The guarantee for defects and faults is 12 months from delivery of the product.
- The customer is required to check the goods upon receipt and report any defects within 7 working days.
- After this deadline, the product is considered accepted.
- without reservations.
If the defect is discovered later, the report must be made within 8 days of discovery.
B2B Warranty Conditions
✔️ What does the warranty cover:
- Manufacturing or conformity defects.
- Technical problems not caused by misuse or accidental damage.
🚫 What the warranty does NOT cover:
- Damage resulting from improper use, tampering or incorrect installation.
- Natural wear and tear or accidental damage.
- Products with broken security seals or removed labels.
- Failures due to incorrect power supply, overvoltages or electrostatic discharges.
- Activated software, licenses, or digital materials.
Warranty Procedure
🔹 How to report a defect covered by the warranty?
1️⃣ Send a request to info@cellcom.it, indicating:
- Order number and invoice.
- Detailed description of the defect.
- Photos/videos showing the problem.
2️⃣ Review and Approval: If the defect is determined to be covered by warranty, we will provide you with a Return Material Authorization (RMA) number and shipping instructions.
3️⃣ Solution: The product will be repaired or replaced based on availability. If repair is not possible, a partial or full refund may be issued, at the discretion of Cellcom Srl.
📌 Return shipping costs are the responsibility of the customer, unless otherwise agreed with Cellcom Srl.
Limitation of Liability
Cellcom Srl is not responsible for indirect damages, economic losses or operational downtime resulting from defective products.
We do not guarantee compatibility with systems or devices not specified in the technical characteristics of the product.
Any delays in delivery or repair do not entitle you to refunds or penalties.
